Terms, Privacy & Security

These Terms & Conditions ("Terms") govern your access to and use of the Stellenbosch Capital website, our hubs, agentic workforces, marketing systems, brand systems and every bespoke deliverable we ship (collectively, the "Services"). By engaging us, browsing this site, booking a call or paying any invoice, you confirm that you have read, understood and accepted these Terms in full.

Paying us to perform any bespoke work constitutes binding acceptance of these Terms, including the limitations of liability set out below. If you do not accept any part of these Terms, you must not commission work from us.

Many of the hubs, sites, marketing systems, ad creatives, scripts and dashboards displayed on this website — including those branded with third-party names such as Nike, Polestar, Vuori, Billabong, Incredible Connection, USN, Dr Robert Rey, A&O Shearman, FIFA and others — are concept builds and demonstrations of our platform's capability. They were not necessarily commissioned, endorsed by or affiliated with the brands shown.

The hubs themselves are real, functional builds — exactly as you can see in our live booking and demos. They demonstrate the actual systems we deploy for paying clients. We use recognised brands purely as a visual reference layer to communicate what is possible.

Takedown requests: If you represent a company whose brand, name or likeness appears on this website and you would like that material removed, please email us at sales@evacktech.co.za and we will action the request promptly and in good faith.

Our Services produce AI-assisted output: websites, marketing hubs, agentic workflows, copy, creatives, scripts, scheduling logic, brand systems and similar artefacts ("Deliverables"). You acknowledge that:

• Deliverables are produced using a combination of human craft, large language models and third-party tooling, all of which can produce unexpected results.
• You are responsible for reviewing every Deliverable before publishing, sending, billing against, or otherwise acting on it.
• You are responsible for ensuring Deliverables comply with the laws, regulations, advertising standards and platform policies that apply to your business and jurisdiction.
• We make no warranty that Deliverables will be error-free, will achieve any specific commercial outcome, or will be free of bias, hallucination or factual inaccuracy.

To the maximum extent permitted by law, Stellenbosch Capital, its directors, employees, contractors and affiliates shall not be liable for any loss, damage, claim, regulatory action, reputational harm, lost profits, lost revenue or third-party claim arising directly or indirectly from:

• any content, copy, creative or output generated by the hubs we build for you;
• any decision you take in reliance on a Deliverable;
• any communication, advertisement or campaign sent or published from a hub;
• any downtime, bug, integration failure or third-party service outage;
• any breach of intellectual property, defamation or unfair competition claim arising from material you instructed us to use or to model the build on.

Our total aggregate liability for any claim relating to the Services will not exceed the fees actually paid by you to us in the three (3) months preceding the event giving rise to the claim.

On full payment of the relevant invoice, you receive a non-exclusive, perpetual licence to use the bespoke Deliverables produced for your business. The underlying platform, hub framework, prompts, agent definitions, infrastructure and tooling remain the exclusive property of Stellenbosch Capital. We may reuse generic components, patterns and learnings across other client engagements.

We take your privacy and your customers' privacy seriously. We only collect the minimum information required to deliver the Services — typically your name, business name, email address, billing details, the briefing material you share with us and the operational data needed to run the hubs we deploy.

We will never:

• sell your data or your customers' data to third parties;
• use your private business data to train public models;
• share commercial information you give us with competitors.

You may request a copy of, or the deletion of, the personal data we hold about you at any time by emailing sales@evacktech.co.za.

Security is treated as a first-class engineering concern at Stellenbosch Capital, not a checkbox. Our standing policies include:

• Minimal API surface. We deliberately build hubs that integrate with as few external APIs as technically possible. Every additional API is an additional attack surface, an additional dependency and an additional point of data leakage — so we only add one when there is no native alternative.
• Least-privilege access. API keys, service accounts and database credentials are scoped to exactly what the hub needs and nothing more.
• Secrets isolation. Credentials are stored in encrypted secret stores, never in client-side code, repositories or shared documents.
• Row-level security. Every database we deploy uses row-level security policies so that one customer can never see another customer's data — even via a misconfigured client.
• Encrypted in transit and at rest. All data moves over HTTPS/TLS and is encrypted at rest by our hosting providers.
• No silent retention. When an engagement ends, we will, on written request, permanently delete the operational data and credentials we hold for you.

If you believe you have discovered a security vulnerability in any system we operate or have built for you, please disclose it responsibly to sales@evacktech.co.za before disclosing it publicly.

You agree not to use our Services to build, send or publish material that is unlawful, defamatory, harassing, fraudulent, infringing on third-party rights, or in breach of any platform's terms of service. We reserve the right to refuse or terminate any engagement that, in our reasonable opinion, falls outside acceptable use.

Specific guarantees (such as our 72-hour setup guarantee) are documented in your individual engagement agreement and prevail over any general statement on this website. Outside of those documented guarantees, all fees are non-refundable once work has commenced.

We may update these Terms from time to time to reflect changes to our Services or to applicable law. The latest version will always be published on this page with an updated date at the top.

These Terms are governed by the laws of the Republic of South Africa. Any dispute that cannot be resolved amicably will be submitted to the exclusive jurisdiction of the South African courts.
